These Terms of Service (the "Terms") set out the conditions for using the smartphone app "Negai" (the "App") provided by Sho Fujimoto (the "Developer"). By using the App, you are deemed to have agreed to these Terms. The App also asks you to agree to these Terms the first time you record a visit.
1. About the App
The App lets you record visits to Shinto shrines and Buddhist temples. Its main features are:
- Finding nearby shrines and temples on a map and in a list
- Recording a visit on the grounds and earning Wish Points
- Adding photos, a note, goshuin photos, and a wish for someone to a visit
- Sending a wish link to that person
- Viewing your records, goshuin book, medals, and prefecture progress
- Viewing the Wish Points ranking
The App is not an official app of any shrine or temple. It is not affiliated with any individual shrine or temple, religious corporation, or organization such as the Association of Shinto Shrines.
2. Conditions of Use
- If you are a minor, please get your parent's or guardian's consent before using the App.
- The App creates an anonymous account for each device. Do not transfer or sell your account to anyone else.
- The App is free to use. It does not show ads and has no in-app purchases.
3. Recording Visits
- You can record a visit when your location accuracy is within 100 m and you are within 300 m of the center of the shrine or temple. You can record one visit per shrine or temple per day (Japan time).
- There are daily limits on the number of visits you can record, photos you can send, and reports you can make (currently 30 visits, 60 photos, and 30 reports).
- Do not record visits by fraudulent means, such as faking your location or recording a visit to a place you did not visit.
- Errors in shrine location data and similar issues may prevent you from recording a visit even when you are on the grounds.
4. Wish Points
- You earn Wish Points by recording visits (currently 10 per visit, or 15 when you add a wish).
- Wish Points are a count used only for your records and the ranking in the App. The Developer does not sell Wish Points.
- Wish Points cannot be exchanged for money, goods, services, or other points, and cannot be transferred to other users.
- If you delete a post, the Wish Points for that visit remain. If you delete your account, your Wish Points are deleted too.
- The Developer may cancel Wish Points earned by fraudulent means and remove the user from the ranking.
5. Posts
5.1 Visibility
- You can set each post (note, photos, and wish) to "Share within Negai" or "Only me." Posts set to "Share within Negai" are shown with your display name on the shrine screen in the App.
- Posts for which you choose "Post anonymously on the shrine website" are shown on the shrine's page on the Negai shrine website, without your display name or "For."
- Anyone who has a wish link can view it. Please choose carefully who you send it to.
- For details on how information is handled, see the Privacy Policy.
5.2 Prohibited Content
Do not post any of the following in notes, photos, wishes, or nicknames.
- Content that others may find offensive, such as sexual, violent, or graphic content
- Defamation, threats, harassment, or discriminatory expressions
- Content that demeans shrines, temples, faith, or worshippers
- Advertising, solicitation, spam, or links to other services
- Information that could identify you or others, such as real names, addresses, phone numbers, or email addresses
- Content that promotes crime, self-harm, or dangerous acts
- Content that infringes copyrights, portrait rights, privacy, or other rights of third parties
- Content that violates laws or public order and morals
5.3 Rules for Taking Photos
- Do not take photos where photography is prohibited (such as inside the main hall, of sacred treasures, or in areas marked as no photography). Follow the rules of each shrine or temple and the instructions of priests and monks.
- Do not take photos in a way that disturbs worship, prayer ceremonies, or other visitors.
- Do not post photos in which other people's faces, such as other visitors, can be clearly recognized, unless you have their consent.
- Post goshuin photos only of goshuin you received yourself.
5.4 Rights to Posts
- The rights to a post belong to the user who posted it.
- You grant the Developer, free of charge, the right to store, copy, resize, and display your posts to the extent needed to show them in the App and on the Negai shrine website. This license ends, to the corresponding extent, when you delete a post or change its visibility.
- You warrant that you have the rights needed to post your content.
5.5 Plan a Day Together (Shrine Website)
- On the Negai shrine website (https://negaiapp.com ), you can create a plan without an account and decide with friends which day to visit a shrine or attend a festival together.
- Anyone with the link can see a plan page. Choose for yourself who to send the link to.
- Do not write any content listed in 5.2 in a plan title, name, note, or comment. Content is checked automatically with OpenAI Moderation before it is stored.
- The organizer link is for editing the plan. Do not send it to others. If you lose it, you can no longer edit the plan. The Developer cannot reissue organizer links.
- Plans and replies are deleted automatically 30 days after the last candidate date (including the chosen date).
- A plan reported by 3 people is hidden. The Developer reviews it, restores it if there is no problem, and deletes it if there is.
6. Content Checks, Reports, and Blocks
- To keep offensive posts out of the App, the App automatically checks the text and photos of posts and nicknames with OpenAI Moderation before storing them. Content judged inappropriate cannot be posted. Automated checks are not guaranteed to catch all inappropriate content.
- You can report other users' posts. Choose a reason from "Spam or ads," "Offensive content," "Harassment," or "Other."
- A post reported by 3 users is hidden everywhere: in the App, on the shrine website, and in wish links. The Developer reviews it, restores it if there is no problem, and deletes it if there is.
- You can block other users. Their posts and ranking entries will no longer be shown to you.
- The Developer may delete posts that violate these Terms without notice and may suspend the use of users who violate them.
7. Prohibited Conduct
- Violating laws, these Terms, or platform rules
- Posting content listed in 5.2 (including in plans under 5.5), or taking photos in violation of 5.3
- Recording visits or earning Wish Points by fraudulent means, such as faking your location
- Creating multiple accounts to abuse the ranking, reports, or blocks
- Stalking or harassing other users
- Disrupting the operation or ceremonies of shrines and temples, or other visitors
- Placing excessive load on the App, servers, or third-party services
- Unauthorized access, reverse engineering, modification, or use of bots
- Exploiting bugs or vulnerabilities in the App
- Copying, reposting, selling, distributing, or modifying the App's content without permission
- Any other conduct the Developer reasonably judges to be inappropriate
8. Shrine Information and Sources
- Shrine and temple locations and names use OpenStreetMap data (© OpenStreetMap contributors, Open Database License).
- Name translations and similar data come from Wikidata (CC0). Enshrined deities and histories come from Japanese Wikipedia articles (CC BY-SA 4.0), and the App links to the source article.
- Map images are served by OpenFreeMap (© OpenStreetMap contributors).
- Shrine information is based on these sources, and its accuracy is not guaranteed. Please check each shrine's or temple's own information for visiting hours, admission fees, goshuin, and similar details.
9. Data Storage and Deletion
- Your account, visits, posts, and photos are stored on the Developer's server.
- Your account is linked through a token stored on your device. If you delete the App, reset your device, or change devices, the token may be lost and your records may not carry over. The Developer cannot restore lost records.
- You can delete a post with "Delete post" on the Records screen, and your account and records with "Delete account and records" on the Settings screen. Neither can be undone.
10. Intellectual Property
All intellectual property rights in the App, images, text, programs, and other content (excluding users' posts and the source data in Section 8) belong to the Developer or the rightful owners. You may use the App only for personal, non-commercial purposes.
11. Third-Party Services
The App uses third-party services for its server infrastructure, content checks, and maps. Your use of these may be subject to each provider's terms and privacy policy.
12. Visiting and Safety
- When visiting, follow the rules and customs of each shrine or temple.
- Do not use your phone while walking. Obey traffic rules and stay aware of your surroundings.
- Do not enter restricted areas, private property, or dangerous places to record a visit.
13. Changes, Suspension, and Termination of the Service
The Developer may change the App's content, features, or how it is provided, or suspend or end the App. If we end the App, we will give reasonable advance notice in the App or elsewhere.
14. Disclaimer
- The Developer does not guarantee that the App is accurate, complete, useful, continuously available, free of bugs, or that it will produce the results you expect. Location measurements and shrine information may contain errors.
- The Developer is not responsible for the content of users' posts. Disputes between users should be resolved between the parties involved.
- The Developer is not liable for any damages you incur in connection with the App, except in cases of the Developer's intentional misconduct or gross negligence. Even where the Developer is liable, liability is limited to direct and ordinary damages actually incurred by you.
- The preceding paragraph does not apply to the extent that the Consumer Contract Act of Japan or other laws do not allow the Developer's liability to be excluded or limited.
15. Changes to These Terms
The Developer may change these Terms as needed. When we do, we will announce the new Terms and their effective date in advance in the App or on our website. By using the App on or after the effective date, you are deemed to have agreed to the revised Terms.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. Any dispute arising in connection with the App shall be subject to the exclusive jurisdiction of the Japanese court having jurisdiction over the Developer's location as the court of first instance. However, disputes with users who are consumers shall be subject to the jurisdiction prescribed by law.
