Furigana AI Terms of Service

These Terms of Service (hereinafter referred to as "Terms") set forth the conditions for use of "Furigana AI" (hereinafter referred to as "the App") provided by Sho Fujimoto (hereinafter referred to as "Developer"). Users (hereinafter referred to as "Users") are required to use the App in accordance with these Terms.

Article 1 (Application)

1. These Terms shall apply to all relationships related to the use of the App between Users and the Developer.
2. The Developer may establish various rules and regulations (hereinafter referred to as "Individual Regulations") regarding the use of the App in addition to these Terms. These Individual Regulations, regardless of their name, shall constitute part of these Terms.

Article 2 (Definitions)

The following terms used in these Terms shall have the meanings set forth below:

1. "The App" means the application named "Furigana AI" provided by the Developer (including the application after any change of name or content for any reason).
2. "User" means an individual who uses the App.
3. "OCR Function" means the function that recognizes characters from images and extracts them as text data.
4. "Furigana Generation Function" means the function that adds reading guides to kanji characters.

Article 3 (Eligibility and Registration)

1. Users may begin using the App by agreeing to these Terms and following the prescribed method.
2. Persons under 13 years of age must obtain parental consent before using the App.
3. If a User is under 13 years of age, it is deemed that their guardian has agreed to these Terms.

Article 4 (Changes to Registration Information)

Users shall promptly update their registration information if any changes occur.

Article 5 (Account Information Management)

1. Users shall appropriately manage their App account information at their own responsibility.
2. Users may not transfer or lend their account information to third parties or share it with third parties under any circumstances.

Article 6 (Prohibited Matters)

Users shall not engage in the following acts when using the App:

1. Acts that violate laws or public order and morals
2. Acts related to criminal activities
3. Acts that destroy or interfere with the functions of the Developer's, other Users', or other third parties' servers or networks
4. Acts that may interfere with the operation of the Developer's services
5. Acts of collecting or accumulating personal information about other Users
6. Acts of unauthorized access or attempts thereof
7. Acts of impersonating other Users
8. Acts of providing benefits directly or indirectly to anti-social forces in connection with the Developer's services
9. Acts that infringe upon the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the Developer, other Users, or other third parties
10. Acts of posting or transmitting expressions containing excessively violent content, explicit sexual content, expressions leading to discrimination based on race, nationality, creed, gender, social status, origin, etc., expressions that induce or promote suicide, self-harm, or drug abuse, or other anti-social content that causes discomfort to others
11. Acts for commercial purposes such as sales, advertising, promotion, solicitation (except those approved by the Developer)
12. Acts aimed at sexual conduct or obscene acts, acts aimed at meeting or dating strangers, acts aimed at harassing or slandering other Users, or other acts of using the App for purposes different from those intended
13. Religious activities or solicitation to religious organizations
14. Other acts deemed inappropriate by the Developer

Article 7 (Free Service and Fees)

1. Basic functions of the App are provided free of charge.
2. Some advanced features (unlimited character recognition, chat function, text-to-speech, etc.) may be provided as paid plans.
3. Fees, payment methods, and other conditions for paid plans shall be separately determined within the App.

Article 8 (Intellectual Property Rights)

1. All copyrights and other intellectual property rights regarding the App and all information related to the App belong to the Developer or those who have licensed the Developer, and Users shall not reproduce, transfer, lend, translate, modify, reprint, publicly transmit (including making transmittable), transmit, distribute, publish, or use for business purposes without permission.
2. The copyright of images and text processed through the App belongs to the original copyright holder.

Article 9 (Changes to and Termination of Service)

1. The Developer may change the content of the App or discontinue providing the App without notifying Users, and shall not be liable for any damages caused to Users thereby.
2. The Developer shall endeavor to notify Users in advance when discontinuing the provision of the App.

Article 10 (Disclaimer)

1. The Developer shall not be liable for any transactions, communications, or disputes that arise between Users and other Users or third parties regarding the App.
2. The Developer shall not be liable for any damages suffered by Users in connection with the interruption, suspension, termination, unavailability or modification of the App, loss of data or equipment failure or damage due to use of the App, or any other matters related to the App.
3. The accuracy of the OCR function and furigana generation function of the App is not 100%. Please understand that misrecognition or incorrect readings may be generated.
4. The App uses Google Gemini API, but the App's functionality may be limited due to interruption, change, or termination of that service.

Article 11 (Handling of User Information)

The handling of user information shall be governed by the separately established "Privacy Policy," and Users agree that user information will be handled in accordance with the Privacy Policy by using the App.

Article 12 (Notices or Communications)

Notices or communications between Users and the Developer shall be made by methods determined by the Developer. Unless the Developer receives notification of changes in accordance with methods separately determined by the Developer, the Developer shall deem the currently registered contact information as valid and send notices or communications to such contact information, which shall be deemed to have reached the User at the time of transmission.

Article 13 (Prohibition of Assignment of Rights and Obligations)

Users may not assign their position under the usage agreement or rights or obligations under these Terms to third parties or provide them as collateral without prior written consent from the Developer.

Article 14 (Severability)

Even if any provision of these Terms or part thereof is determined to be invalid or unenforceable, the remaining provisions of these Terms and the remaining parts of provisions determined to be partially invalid or unenforceable shall continue to remain in full force and effect.

Article 15 (Governing Law and Jurisdiction)

1. The interpretation of these Terms shall be governed by Japanese law.
2. In the event of any dispute regarding the App, the court having jurisdiction over the Developer's address shall have exclusive agreed jurisdiction.
