Terms of Service
These Terms of Service (“Terms”) govern the BookmarkAI mobile application (the “App”) provided by Sho Fujimoto (the “Developer”). By using the App, you agree to these Terms.
1. Service
The App retrieves webpages, generates AI summaries and categories, stores and searches bookmarks on your device, and provides AI chat about saved articles. Features, AI usage allowances, and other service conditions are as shown in the App.
2. Eligibility and use
- The App generally does not require account registration.
- You may submit only webpages and information that you have the right to use.
- Minors must obtain a guardian's consent when required. The App is not directed to children under 13.
3. AI features
- The App uses DeepSeek as its primary AI generation service and OpenAI for safety moderation and as a fallback when DeepSeek cannot complete a request.
- AI summaries, categories, and answers may contain errors, omissions, or inappropriate material. You must verify the original article and use outputs at your own discretion and risk.
- Do not rely solely on AI output for medical, legal, financial, or other consequential decisions.
4. Subscriptions
- The App may offer auto-renewing subscriptions through the App Store or Google Play. Included features, usage allowances, any trial, price, and subscription period are those displayed in the App and applicable store when you purchase.
- Purchases, billing, renewal, cancellation, and refunds are governed by the terms and procedures of the store where you purchased. You must disable auto-renewal through your store account within the period specified by that store.
- RevenueCat manages subscription entitlements. The Developer does not directly receive payment-card details.
- Reasonable usage limits may apply to maintain service stability and fairness or to comply with third-party service constraints.
5. Prohibited conduct
You must not:
- Violate applicable law or public policy;
- Infringe intellectual property, privacy, or other rights;
- Submit personal, confidential, or other information without necessary authorization;
- Circumvent authentication, usage limits, or security controls;
- Place an excessive load on the App or external AI services;
- Use the App for unauthorized automation, as a general-purpose AI proxy, or outside its intended purpose; or
- Otherwise interfere with operation of the App.
The Developer may restrict or suspend use that violates or appears likely to violate these Terms.
6. Intellectual property
The App and its intellectual property belong to the Developer or applicable rights holders. Rights in original webpages and information you submit remain with their respective owners. Use of the App does not grant a right to reproduce or redistribute third-party content.
7. Data
Bookmarks, summaries, article text, and article-chat history are generally stored on your device. You are responsible for backups. The Developer is not responsible for data loss caused by device failure, App deletion, or similar events. See the Privacy Policy for information sent externally during AI processing.
8. Changes and interruption
The Developer may change, suspend, or discontinue all or part of the App due to maintenance, failures, changes to third-party services, or other reasonable circumstances. Notice will be provided when reasonably practicable.
9. Disclaimer and limitation of liability
- The App is provided “as is,” without warranties of accuracy, completeness, continuity, or fitness for a particular purpose.
- To the extent permitted by law, the Developer is not liable for damages arising from use of the App except where caused by the Developer's willful misconduct or gross negligence. Any non-excludable consumer-protection law remains applicable.
10. Changes to these Terms
The Developer may update these Terms when necessary. Material changes will be announced in the App or on this website.
11. Governing law and jurisdiction
These Terms are governed by Japanese law. To the extent permitted by law, disputes are subject to the court having jurisdiction over the Developer's address as the court of first instance.
