Voice English Terms of Service

These Terms of Service (hereinafter "Terms") establish the conditions for using the application "Voice English" (hereinafter "App") provided by Sho Fujimoto (hereinafter "Developer"). Users (hereinafter "Users") must agree to these Terms before using the App.

Article 1 (Application of Terms)

1. These Terms apply to all relationships between Users and the Developer regarding the use of the App.
2. The Developer may establish various rules and regulations (hereinafter "Individual Regulations") regarding the App in addition to these Terms. These Individual Regulations, regardless of their names, constitute part of these Terms.
3. If provisions of these Terms contradict Individual Regulations, the Individual Regulations shall prevail unless otherwise specified.

Article 2 (Definitions)

The following terms used in these Terms shall have the meanings defined below:

1. "Service" means the English learning features, voice conversation features, grammar checking features, and all related services provided by the Developer through the App.
2. "Usage Fee" means the fee paid by Users to the Developer for paid features if added in the future.
3. "Voice Data" means voice information input or generated by Users through the App.
4. "AI Characters" means artificially intelligent characters that converse in English with Users within the App.
5. "Learning Data" means information about Users' learning progress, scores, practice history, etc.

Article 3 (Eligibility and Registration)

1. Users may use the Service by downloading the App according to prescribed methods after agreeing to these Terms.
2. Minors must obtain parental consent to use the Service.
3. Users must provide true and accurate information about themselves when using the Service.
4. The App is available only to those who intend to learn English.

Article 4 (Changes to Registration Information)

Users must promptly update their registration information if any changes occur.

Article 5 (Account Management)

1. Users are responsible for properly managing their Service account information.
2. Users may not transfer, lend, or share their account information with third parties under any circumstances.
3. The Developer considers any login with matching account information as use by the registered User.
4. Users bear responsibility for damages arising from insufficient management, usage errors, or third-party use of account information.

Article 6 (Prohibited Actions)

Users must not engage in the following actions when using the Service:

1. Actions violating laws or public order and morals
2. Actions related to criminal activities
3. Actions that destroy or interfere with servers or networks of the Developer, other Users, or third parties
4. Actions that may interfere with Service operations
5. Collecting or accumulating personal information about other Users
6. Unauthorized access or attempts thereof
7. Impersonating other Users
8. Providing benefits directly or indirectly to antisocial forces in connection with the Service
9. Infringing intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the Developer, other Users, or third parties
10. Posting or transmitting content that includes or is deemed by the Developer to include:
    • Excessively violent expressions
    • Explicit sexual expressions
    • Expressions leading to discrimination based on race, nationality, belief, gender, social status, or origin
    • Expressions inducing or promoting suicide, self-harm, or drug abuse
    • Other antisocial content causing discomfort to others
11. Actions aimed at or deemed by the Developer to be aimed at:
    • Sales, advertising, solicitation, or other commercial purposes (except those approved by the Developer)
    • Sexual or obscene purposes
    • Meeting or dating strangers
    • Harassment or defamation of other Users
    • Causing disadvantage, damage, or discomfort to the Developer, other Users, or third parties
    • Using the Service for purposes other than intended
12. Religious activities or solicitation to religious organizations
13. Attempting to deceive AI into providing inappropriate responses
14. Excessive use beyond learning purposes
15. Other actions deemed inappropriate by the Developer

Article 7 (Service Provision and Fees)

1. Basic features of the Service are provided free of charge.
2. Users will be notified in advance if paid features are added in the future.
3. Use of paid features requires payment of fees separately determined by the Developer.

Article 8 (Intellectual Property Rights)

1. All intellectual property rights related to the App and Service belong to the Developer or licensors, and permission to use the Service under these Terms does not imply transfer or licensing of intellectual property rights.
2. Users agree that the Developer may use content generated through the Service for service improvement.
3. While copyright of content posted by Users through the Service belongs to Users, the Developer may use such content free of charge for Service promotion, improvement, and research and development.

Article 9 (Changes, Suspension, and Termination of Service)

1. The Developer may change Service content or discontinue Service provision without notifying Users and bears no responsibility for resulting damages.
2. The Developer may suspend or interrupt all or part of the Service without prior notice to Users if:
   • Maintenance, inspection, or updates of computer systems are necessary
   • Service provision becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
   • Computers or communication lines stop due to accidents
   • AI service providers (Google Gemini, DeepSeek, LemonFox, etc.) stop or change their services
   • The Developer determines Service provision is difficult for other reasons

Article 10 (Disclaimer)

1. The Developer's liability for breach of obligation is exempted unless due to willful misconduct or gross negligence.
2. The Developer bears no responsibility for transactions, communications, or disputes between Users and other Users or third parties regarding the Service.
3. The Developer bears no responsibility for damages suffered by Users (hereinafter "User Damages") including Service interruption, suspension, termination, unavailability or changes, deletion or loss of messages or information sent through the Service, deletion of User registration, data loss or device failure or damage from Service use, or other Service-related damages.
4. The Developer bears no responsibility for the accuracy of information obtained from other websites linked from the Service or Developer website.
5. The Developer does not guarantee the accuracy, usefulness, or timeliness of information, advice, or answers provided by AI Characters through the Service.
6. The Developer does not guarantee Users' English learning outcomes.
7. The Developer does not guarantee the accuracy of grammar checking features.

Article 11 (Handling of User Information)

The Developer's handling of User information is governed by the separately established "Voice English Privacy Policy," and Users agree to the Developer's handling of User information according to this Privacy Policy.

Article 12 (Changes to Terms)

1. The Developer may change these Terms at any time without notifying Users when deemed necessary.
2. Unless otherwise specified by the Developer, revised Terms take effect when posted on the App.
3. If Users use the Service after Terms changes, they are deemed to have agreed to the revised Terms.

Article 13 (Contact/Notification)

1. Inquiries and other communications from Users to the Developer and from the Developer to Users regarding the Service shall be made by methods determined by the Developer.
2. Unless Users submit change notifications according to methods separately determined by the Developer, the Developer considers currently registered contact information valid and communications sent there are deemed received upon transmission.

Article 14 (Assignment of Status)

1. Users may not assign their status under these Terms or rights or obligations based on these Terms to third parties or provide them as collateral without prior written consent from the Developer.
2. If the Developer transfers the Service business to another company, the Developer may transfer contractual status, rights and obligations under these Terms, and User registration and other information to the transferee, and Users consent to such transfer in advance.

Article 15 (Severability)

Even if any provision of these Terms or part thereof is determined invalid or unenforceable under consumer contract laws or other regulations, the remaining provisions and parts of provisions determined partially invalid or unenforceable shall continue in full force and effect.

Article 16 (Governing Law and Jurisdiction)

1. These Terms shall be governed by Japanese law.
2. Any disputes regarding the Service shall be under the exclusive jurisdiction of the court with jurisdiction over the Developer's location.
