Voice Chat Terms of Service
These Terms of Service (hereinafter referred to as "Terms") set forth the terms and conditions for the use of the application "Voice Chat" (hereinafter referred to as "App") provided by Sho Fujimoto (hereinafter referred to as "Developer"). Users (hereinafter referred to as "Users") are required to use the App in accordance with these Terms.
Article 1 (Application of Terms)
- These Terms shall apply to all relationships related to the use of the App between Users and the Developer.
- The Developer may establish various rules and regulations (hereinafter referred to as "Individual Regulations") regarding the use of the App in addition to these Terms. These Individual Regulations, regardless of their names, shall constitute a part of these Terms.
- In the event of any conflict between the provisions of these Terms and the Individual Regulations, the Individual Regulations shall prevail unless otherwise specified in the Individual Regulations.
Article 2 (Definitions)
The following terms used in these Terms shall have the meanings set forth below:
- "Service" means the voice chat functionality provided by the Developer in the App and all related services.
- "Usage Fee" means the fee paid by Users to the Developer as consideration for paid features if added in the future.
- "Voice Data" means voice information input or generated by Users through the App.
- "AI Character" means an artificial intelligence-equipped character that interacts with Users within the App.
Article 3 (Eligibility and Registration)
- Users may use the Service by downloading the App in the prescribed manner after agreeing to these Terms.
- When minors use the Service, they must obtain consent from their parents or guardians.
- Users must provide true and accurate information about themselves when using the Service.
Article 4 (Changes to Registered Information)
Users shall promptly update their registration information if any changes occur.
Article 5 (Account Information Management)
- Users shall be responsible for properly managing their account information for the Service.
- Users may not transfer, lend, or share their account information with third parties under any circumstances.
- The Developer shall consider any use of the Service with matching account information as use by the registered User.
Article 6 (Prohibited Matters)
Users shall not engage in the following acts when using the Service:
- Acts that violate laws or public order and morals
- Acts related to criminal activities
- Acts that destroy or interfere with the functions of the Developer's, other Users', or third parties' servers or networks
- Acts that may interfere with the operation of the Developer's services
- Acts of collecting or accumulating personal information about other Users
- Acts of unauthorized access or attempts thereof
- Acts of impersonating other Users
- Acts of providing benefits directly or indirectly to anti-social forces in connection with the Developer's services
- Acts that infringe upon the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the Developer, other Users, or third parties
- Acts of posting or transmitting content on the Service that includes or is determined by the Developer to include:
- Excessively violent expressions
- Explicit sexual expressions
- Expressions that lead to discrimination based on race, nationality, creed, gender, social status, or lineage
- Expressions that induce or promote suicide, self-harm, or drug abuse
- Other antisocial content that causes discomfort to others
- Acts for the following purposes or that the Developer determines to be for such purposes:
- Business, promotion, advertising, solicitation, or other profit-making purposes (except those approved by the Developer)
- Acts for the purpose of sexual conduct or obscene acts
- Acts for the purpose of meeting or dating strangers of the opposite sex
- Acts for the purpose of harassing or slandering other Users
- Acts for the purpose of causing disadvantage, damage, or discomfort to the Developer, other Users, or third parties
- Other acts using the Service for purposes different from the intended use
- Religious activities or solicitation to religious organizations
- Other acts that the Developer deems inappropriate
Article 7 (Free Service)
This Service is provided free of charge. If paid features are added in the future, Users will be notified in advance.
Article 8 (Intellectual Property Rights)
- All intellectual property rights related to the App and the Service belong to the Developer or those who have licensed the Developer, and the license to use the Service based on these Terms does not mean the transfer or license of intellectual property rights related to the App or the Service by the Developer or those who have licensed the Developer.
- Users agree that the Developer may use content generated through the Service for service improvement purposes.
Article 9 (Changes, Suspension, and Termination of Service)
- The Developer may change the content of the Service or discontinue the provision of the Service without notice to Users, and shall not be liable for any damages caused to Users thereby.
- The Developer may suspend or interrupt all or part of the Service without prior notice to Users if the Developer determines that any of the following circumstances exist:
- When performing maintenance, inspection, or updates of the computer system related to the Service
- When it becomes difficult to provide the Service due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
- When computers or communication lines are stopped due to accidents
- When the Developer determines that it is difficult to provide the Service for other reasons
Article 10 (Disclaimer)
- The Developer's liability for breach of contract shall be exempted except in cases of intentional misconduct or gross negligence by the Developer.
- The Developer shall not be liable for any transactions, communications, or disputes that arise between Users and other Users or third parties in connection with the Service.
- The Developer shall not be liable for any damages suffered by Users (hereinafter referred to as "User Damages") in connection with the Service, including interruption, suspension, termination, unavailability or changes to the Service, deletion or loss of messages or information sent by Users to the Service, deletion of User registrations, loss of data or equipment failure or damage due to use of the Service, or any other damages related to the Service.
- The Developer shall not be liable for the accuracy of information obtained from the Service or from other websites linked from the Developer's website.
- The Developer does not guarantee the accuracy, usefulness, or timeliness of information, advice, or responses provided by AI Characters through the Service.
Article 11 (Handling of User Information)
The handling of User information by the Developer shall be governed by the separately established "Voice Chat Privacy Policy," and Users agree that the Developer will handle User information in accordance with this Privacy Policy.
Article 12 (Changes to Terms)
- The Developer may change these Terms at any time without notice to Users when deemed necessary.
- Unless otherwise specified by the Developer, the revised Terms shall take effect from the time they are posted on the App.
- If Users use the Service after changes to these Terms, such Users shall be deemed to have agreed to the revised Terms.
Article 13 (Contact/Notifications)
- Inquiries about the Service and other communications or notifications from Users to the Developer, and communications or notifications from the Developer to Users, shall be made in the manner prescribed by the Developer.
- Unless the Developer receives a change notification from Users in accordance with the format separately determined by the Developer, the Developer shall consider the currently registered contact information to be valid and shall send communications or notifications to such contact information, which shall be deemed to have reached Users at the time of transmission.
Article 14 (Assignment of Status)
- Users may not assign their status under these Terms or rights or obligations based on these Terms to third parties or provide them as collateral without the prior written consent of the Developer.
- If the Developer transfers the business related to the Service to another company, the Developer may transfer the status under the usage contract, rights and obligations based on these Terms, and User registration information and other information to the transferee of such business transfer, and Users hereby consent in advance to such transfer in this section.
Article 15 (Severability)
Even if any provision of these Terms or part thereof is determined to be invalid or unenforceable under the Consumer Contract Act or other laws and regulations, the remaining provisions of these Terms and the remaining parts of provisions determined to be partially invalid or unenforceable shall continue to remain in full force and effect.
Article 16 (Governing Law and Jurisdiction)
- The interpretation of these Terms shall be governed by Japanese law.
- Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Developer.
