Privacy Policy

I, Sho Fujimoto (hereinafter referred to as the "Developer"), establish this Privacy Policy (hereinafter referred to as "this Policy") regarding the handling of user information in the mobile application "TryOn" (hereinafter referred to as "this App"). This App is provided as a service operated through advertising display and is intended to be used "as is." This Policy aims to comply with the Act on the Protection of Personal Information (hereinafter referred to as the "Personal Information Protection Act") and to appropriately protect users' privacy information.

Article 1 (Definition of Privacy Information)

In this Policy, "Privacy Information" refers to the combination of "Personal Information" and "Usage History and Characteristic Information."

  1. Personal Information: Refers to "personal information" as defined in the Personal Information Protection Act. Specifically, it includes information that can identify a specific individual, such as name, contact information (email address, phone number, etc.), account identifiers, and other descriptions.

  2. Usage History and Characteristic Information: Refers to information collected when users use this App, other than the "Personal Information" mentioned above. Specifically, this includes functions used, pages viewed in this App, viewing date and time, time spent on each page, usage time of this App, input information to generative AI (including image data, but these are not stored on the Developer's servers), search keywords, usage methods, usage environment (device OS information, model name, communication status, settings, etc.), IP address, cookie information, location information (with user permission), advertising identifiers (IDFA, AAID, etc.), device-specific IDs, purchase history (point purchase information), etc.

Article 2 (Methods of Collecting Privacy Information)

The Developer may collect users' privacy information through the following methods:

  1. Provision by Users: When users register an account (this App may use account information provided by Apple or Google for point management, etc.) or use the contact form, they may provide personal information such as email addresses and other information.

  2. Automatic Collection During App Use: To improve user convenience, improve services, and display appropriate advertisements, the Developer may automatically collect usage history and characteristic information related to the use of this App (access logs, operation history, pages viewed in this App, viewing date and time, time spent on each page, input images to generative AI, purchase information, etc.), and usage environment (device information, OS information, IP address, cookies, advertising identifiers, location information).

  3. Camera Roll Access: To use the image try-on function of this App, the Developer may request access permission to the user's device camera roll (photo library). Through this access, image data explicitly selected by users (model images and clothing images) are temporarily used for try-on processing. The selected image data and generated try-on images are not stored on the Developer's servers. Access permission is optional for users, but if denied, the main functions of this App cannot be used.

  4. Point Purchase Information: Information regarding point purchases in this App is collected through the Apple App Store or Google Play Store. The Developer does not directly obtain or store users' payment information such as credit card information.

  5. Location Information: This App may collect location information from users' devices (only with user permission). The collected location information is used to provide personalized content, provide relevant recommendations, provide location-based service features, analyze user behavior, identify trends, improve overall App performance and functionality, and optimize advertising.

Article 3 (Purposes of Using Privacy Information)

The Developer uses collected privacy information for the following purposes:

  1. To provide, maintain, protect, and improve this service (including image try-on processing by generative AI and provision of personalized content)
  2. For user identification, authentication, and account management
  3. To respond to user inquiries
  4. To make communications including important notices about this App, necessary notifications, and marketing promotions
  5. To respond to violations of terms of use and prevent unauthorized use (including detection and prevention of inappropriate content)
  6. To analyze service usage, create statistical data, improve services, and develop new services
  7. To provide image selection function from camera roll and image data try-on processing
  8. To provide, manage point purchase services and related notifications
  9. For advertising delivery and effectiveness measurement (may analyze collected information to select and display advertisements presumed to be of higher interest to users)
  10. For purposes incidental to the above purposes

Article 4 (Use of Generative AI)

This App uses generative AI technology provided by third parties (e.g., Replicate, Stability AI, OpenAI, Google, etc., hereinafter referred to as "AI Service Providers") for image try-on processing. Image data selected by users (model images and clothing images) may be transmitted to the servers of such AI Service Providers for the purpose of try-on processing. Please check the privacy policy of the relevant AI Service Provider for how the transmitted information is handled by them. (The names of AI Service Providers and links to their privacy policies are posted separately in the App or on the website.) The Developer does not store users' image data or generated try-on images on the Developer's servers.

Article 5 (Prohibition of Inappropriate Content)

This App aims to provide a wholesome service and prohibits the generation of inappropriate content such as:

  • Nudity or sexually explicit content
  • Violent or offensive content
  • Content that promotes illegal activities
  • Content that infringes on the rights of others

The Developer may implement technical restrictions to prevent the generation of inappropriate content. Additionally, if usage violating the terms of use is confirmed, measures such as account suspension may be taken.

Article 6 (Use of Third-Party Services and Information Collection Modules)

This App may use services and information collection modules provided by the following third parties for service provision, usage analysis, advertising delivery, etc. Please check each company's website for information obtained by these third parties, purposes of use, privacy policies, opt-out methods, etc.

  1. Google Play Services

  2. AdMob

  3. Expo

The Developer may periodically transmit only aggregated and anonymized data that cannot identify individuals to external services for the purpose of improving this App and services.

Article 7 (Provision of Privacy Information to Third Parties)

Except for the cases specified in Articles 4 and 6, the Developer will not provide personal information to third parties without obtaining users' prior consent in the following cases:

  1. When based on laws and regulations
  2. When necessary for the protection of human life, body, or property, and when it is difficult to obtain the consent of the person
  3. When particularly necessary for improving public health or promoting the sound growth of children, and when it is difficult to obtain the consent of the person
  4. When it is necessary to cooperate with a national agency, local government, or a person entrusted by them in executing affairs prescribed by law, and obtaining the consent of the person may hinder the execution of such affairs (including fraud investigations and responding to government requests)
  5. When outsourcing all or part of the handling of personal information within the scope necessary to achieve the purpose of use (contractors are limited to trusted service providers who perform work for the Developer, agree not to use disclosed information independently, and agree to comply with the rules set forth in this Privacy Policy. Appropriate supervision will be exercised over contractors)
  6. When personal information is provided due to business succession through merger or other reasons
  7. When the Developer sincerely determines that disclosure is necessary to protect the Developer's rights, user safety, or the safety of others

Article 8 (Disclosure, Correction, Suspension of Use of Personal Information, etc.)

  1. When the Developer receives a request from the user for notification of the purpose of use, disclosure, correction of content, addition or deletion, or suspension of use or erasure, or suspension of provision to third parties (hereinafter referred to as "Disclosure, etc.") of their personal information based on the provisions of the Personal Information Protection Act, the Developer will respond without delay after confirming the identity of the person (if the personal information does not exist, the Developer will notify the user accordingly). However, this does not apply when the Developer is not obligated to perform Disclosure, etc. under the Personal Information Protection Act or other laws and regulations.

  2. A fee of 1,000 yen per case may be charged for notification of the purpose of use and disclosure of personal information.

  3. For specific procedures for requesting Disclosure, etc., please contact the inquiry desk in Article 17.

Article 9 (Correction and Deletion of Personal Information)

  1. Users can request correction or deletion of personal information if their personal information held by the Developer is incorrect, following procedures determined by the Developer.

  2. If the Developer receives a request from the previous section and determines it is necessary to respond to the request, the Developer will correct or delete the relevant personal information without delay and notify the user.

Article 10 (Opt-Out Rights)

Users can easily stop the collection of user information by this App by uninstalling this App. Please use the standard uninstallation procedures provided by your mobile device or mobile application marketplace (App Store, Google Play Store, etc.). Additionally, if you do not wish to receive personalized advertising, you can limit the use of advertising identifiers by changing the OS settings of your mobile device (such as "Limit Ad Tracking" for iOS or "Opt out of Ads Personalization" for Android). However, this does not mean that advertisements will be hidden.

Article 11 (Data Retention Policy)

The Developer will retain collected user information for the period during which users use this App and for a reasonable period necessary for service provision, compliance with legal obligations, dispute resolution, and contract performance. However, image data and generated try-on images are promptly deleted after processing is completed and are not stored on the Developer's servers. If users wish to delete user information they have provided, please contact the inquiry desk in Article 17. We will respond within a reasonable time.

Article 12 (Children's Privacy)

The Developer does not intentionally collect personal information from children under 13 years of age or conduct marketing targeting children under 13 years of age. This App is not intended for persons under 13 years of age. If it is discovered that a child under 13 has provided personal information, the Developer will immediately delete such information from the Developer's servers. If parents or guardians notice that their child has provided personal information, please contact the inquiry desk in Article 17. We will take necessary measures.

Article 13 (Security Management of Privacy Information)

The Developer will take necessary and appropriate measures, including physical, electronic, and procedural protective measures, to prevent leakage, loss, or damage of handled privacy information and for other security management. We strive to implement technical and physical security measures. Specifically, this includes encryption of communications, implementation of access controls, and non-storage of data (especially image data). For specific details of security management measures, please contact the inquiry desk in Article 17.

Article 14 (Changes to Privacy Policy)

  1. The Developer may change the content of this Policy at any time as necessary.

  2. The changed Privacy Policy will be announced by updating this App or this page (Privacy Policy page). Users are encouraged to regularly check for changes to this Policy. In cases where changes require user consent under law, the Developer will obtain user consent through methods prescribed by the Developer. If users continue to use this App after changes (excluding changes requiring legal consent), they will be deemed to have agreed to the changed Policy.

Article 15 (Governing Law)

The interpretation of this Policy shall be governed by Japanese law.

Article 16 (Consent)

By using this App, users are deemed to have consented to the processing (collection, use, provision, etc.) of user information as defined in this Policy, including current and future revisions.
