Terms of Service

These Terms of Service (the "Terms") govern your use of the mobile application "Korean Boyfriend Audition" (the "App") provided by Sho Fujimoto (the "Developer"). By installing, accessing, using, posting to, uploading to, or otherwise interacting with the App, you agree to these Terms and the Privacy Policy.

1. Scope

1. These Terms apply to the App and all services, features, content, communications, rankings, public posts, AI-generated responses, and related services provided through the App (collectively, the "Service").
2. Any guidelines, notices, community rules, help pages, or other rules posted in the App or on the Developer's website form part of these Terms.
3. If you do not agree to these Terms, do not use the App and uninstall it if necessary.

2. The Service

1. The Service provides entertainment features such as fictional conversations with AI-generated Korean male idol trainee characters, fan support, rankings, stage events, public fan letters, public stage comments, AI-generated replies, and related experiences.
2. Characters, conversations, evaluations, replies, rankings, stage events, and related effects are fictional. They do not represent real people, agencies, idol groups, real romantic relationships, professional advice, or guaranteed real-world outcomes.
3. The Service is not a dating, matchmaking, marriage brokerage, sexual services, escort, or real-world contact service.

3. Definitions

1. "User Content" means text, nicknames, profile images, avatars, fan letters, stage live messages, votes, ratings, support actions, and other information that a user enters, sends, posts, uploads, configures, or displays in the Service.
2. "Public User Content" means User Content that can be viewed or accessed by at least some other users. This includes public fan letters, stage live messages, nicknames and avatars shown in public rankings, author labels, and other publicly displayed information that may be subject to reporting.
3. "Input Data" means information that a user enters or sends for AI response generation, stage evaluations, public reply generation, translation, or other Service features.
4. "Generated Data" means text, replies, evaluations, conversations, translations, effects, or other information generated by AI or the Service based on Input Data or other information.
5. "Moderation" means filtering, reviewing, hiding, removing, reporting, blocking, restricting, or otherwise addressing Public User Content, Input Data, Generated Data, profile information, or other content in the Service.

4. Eligibility

1. The App is not intended for children under 13. Users under 13 may not use the Service.
2. If you are a minor in your jurisdiction, you may use the Service only with consent from your parent or legal guardian.
3. The App is not intended to be offered as an Apple Kids Category app or a Google Play Families app.
4. The Developer may refuse or restrict use of the Service if the Developer determines that a user has violated these Terms, previously violated these Terms, is connected to antisocial forces or illegal activities, or may interfere with safe operation of the Service.

5. User Responsibilities

1. You are responsible for your use of the Service and for all User Content that you send or make public.
2. You represent and warrant that you have the rights necessary to submit your User Content and that your User Content does not infringe the rights of any third party.
3. You must not post or send personal data, confidential information, sensitive information, contact details, location information, identity documents, financial information, health information, or other information that should not be made public.
4. You must not exploit bugs, errors, AI mistakes, ranking or point behavior, ads, network failures, or other system behavior to obtain improper benefits or disrupt the fairness of the Service.

6. Public User Content and Community Rules

1. Before creating, posting, uploading, or publishing Public User Content, you must accept these Terms and the community rules in this section.
2. You understand that Public User Content may be visible to other users. Only post information that you are comfortable making public.
3. The Developer may moderate Public User Content using pre-post filters, AI or automated review, human review, user reports, and other reasonable methods.
4. If the Developer determines that Public User Content violates these Terms, applicable law, app store policies, advertising policies, community rules, or safety standards, the Developer may hide or remove the content, adjust rankings or points, restrict posting features, restrict use by account or device identifier, or take other necessary measures without prior notice.
5. The Developer will respond to user reports within a reasonable scope. The Developer does not guarantee disclosure of individual decisions, investigation details, reasons, or actions taken.

7. Prohibited Content and Conduct

You must not enter, send, post, upload, publish, or engage in any of the following:

1. Content or conduct that violates law or public order
2. Criminal, illegal, fraudulent, impersonating, phishing, identity misuse, or other deceptive conduct
3. Child sexual exploitation, child abuse, grooming, sexualization of minors, or content encouraging sexual or romantic contact with minors
4. Pornography, explicit sexual content, sexual services, prostitution, compensated sexual acts, sexual matchmaking, or sexual solicitation
5. Dating, solicitation of romantic partners, real-world contact exchange, marriage brokerage, international marriage brokerage, or real-world meetings with strangers as a primary purpose
6. Violence, threats, terrorism, extremism, weapons misuse, dangerous acts, illegal drugs, excessive alcohol use, or content encouraging physical or mental harm
7. Content encouraging, praising, or materially assisting suicide, self-harm, eating disorders, or harm to oneself or others
8. Hate, discrimination, insults, exclusion, or harassment based on race, ethnicity, nationality, religion, sex, sexual orientation, gender identity, disability, age, social status, or other protected characteristics
9. Defamation, bullying, harassment, stalking, threats, doxxing, publication of personal information, or calls for coordinated abuse
10. Impersonating real people, celebrities, public figures, idols, entertainers, or third parties without permission, or depicting real people in a sexual, insulting, misleading, or rights-infringing way
11. Content or conduct that infringes copyright, trademarks, publicity rights, privacy, reputation, trade secrets, or other rights
12. False or misleading information, spam, excessive promotion, inappropriate external links, fake reviews, or manipulation of rankings, points, reports, blocks, or ad serving
13. Interfering with, bypassing, abusing, reverse engineering, scraping, automating, or attacking the Service, servers, networks, APIs, ads, payments, moderation, reporting, or blocking features
14. If ads are shown, invalid ad clicks, invalid impressions, ad manipulation, improper ad incentives, or other conduct that violates advertising policies
15. Any other content or conduct that the Developer determines is inappropriate, unsafe, or harmful to operation of the Service

8. Reporting, Blocking, and Removal

1. You may report inappropriate Public User Content or inappropriate Generated Data through in-app reporting features or the contact information below.
2. You may be able to block a poster so that their public posts are hidden from your view.
3. Reported content may be retained for investigation, evidence preservation, abuse prevention, legal compliance, app store review, advertising policy compliance, and dispute handling.
4. Depending on severity, urgency, repetition, risk of harm, legal requirements, and platform policy requirements, the Developer may hide or remove posts, restrict users or device identifiers, report matters to relevant authorities, or take other reasonable measures.
5. You must not misuse reporting or blocking features for harassment, false reports, excluding others, manipulating rankings, or any other improper purpose.

9. AI-Generated Content

1. The Service may use generative AI to create conversations, replies, stage evaluations, translations, and other text.
2. Generated Data may contain errors, inaccurate information, offensive wording, or unintended content. You are responsible for reviewing and using Generated Data at your own risk.
3. Generated Data is fictional entertainment content and is not legal, medical, financial, psychological, romantic, employment, educational, or other professional advice.
4. You must not use AI features to generate prohibited content, violate law, infringe rights, extract personal information, bypass security, or pursue other improper purposes.
5. You may report inappropriate Generated Data through in-app reporting features or the contact information below.

10. Advertising

1. The App may not currently display ads, but may display ads in the future through Google AdMob or other advertising services.
2. If ads are introduced, advertising identifiers, device information, IP addresses, usage information, ad impressions, clicks, and consent status may be processed by advertising providers for ad serving, measurement, fraud prevention, personalized advertising, and consent management. Details are provided in the Privacy Policy.
3. You must not engage in invalid ad clicks, invalid impressions, ad manipulation, ad serving interference, or other conduct that violates advertising policies.
4. Advertisers and other third parties are responsible for their ads, destinations, products, and services. The Developer is not responsible for third-party ads except to the extent required by law.

11. Paid Features

1. The App may offer optional in-app purchases, subscriptions, ad removal, additional usage limits, or other paid features in the future.
2. If paid features are offered, price, period, content, renewal conditions, cancellation method, refund conditions, and other required information will be shown in the purchase screen, App Store, Google Play, or the App.
3. Purchases, refunds, cancellations, renewals, and subscription management through the App Store or Google Play are handled under each store's rules and procedures. The Developer may not be able to issue direct refunds for payments processed through the stores.

12. Intellectual Property

1. The App, Service, characters, screens, designs, programs, text, images, audio, logos, databases, and other Service materials are owned by the Developer or the relevant rights holders.
2. Rights in User Content remain with the user or relevant rights holder. However, you grant the Developer a worldwide, non-exclusive, royalty-free license to use User Content as necessary to provide, display, store, back up, translate, moderate, investigate reports, improve the Service, comply with law, respond to app store review, and comply with advertising policies.
3. You agree not to assert moral rights or similar rights against the Developer or successors or licensees for the uses described above.
4. Rights and usage conditions for Generated Data are subject to applicable law, AI provider terms, these Terms, and Service specifications. You are responsible for using Generated Data without infringing third-party rights.

13. Changes, Suspension, and Termination

1. The Developer may change, add, suspend, or terminate the Service, features, specifications, displays, usage conditions, regions, supported devices, ads, rankings, points, and moderation standards without prior notice.
2. The Developer may suspend or interrupt all or part of the Service for maintenance, failures, network issues, third-party service outages, disasters, unauthorized access, legal or platform policy compliance, advertising policy compliance, or other unavoidable reasons.
3. The Developer is not liable for damages caused by the above except in cases of intentional misconduct or gross negligence by the Developer.

14. Disclaimers

1. The Developer does not guarantee that the Service will be safe, accurate, complete, useful, current, fit for a particular purpose, continuous, error-free, bug-free, non-infringing, or able to produce expected results.
2. The Developer is not responsible for Generated Data, Public User Content, ads, third-party services, external links, or actions of other users except to the extent required by law.
3. Even if you suffer damages related to the Service, the Developer is not liable except in cases of intentional misconduct or gross negligence. Where liability cannot be excluded by law, liability is limited to direct and ordinary damages actually incurred.

15. Privacy

The Developer's handling of user information is described in the Privacy Policy. By using the Service, you agree that the Developer may handle user information in accordance with the Privacy Policy.

16. Changes to These Terms

1. The Developer may change these Terms as necessary.
2. Updated Terms become effective when posted in the App or on the Developer's website. If consent is required by law, the Developer will obtain consent in the manner specified by the Developer.
3. If you continue to use the Service after the Terms are changed, you are deemed to have agreed to the updated Terms.

17. Notices and Contact

1. You may contact the Developer regarding the Service, reports, objections, or other matters through in-app reporting or inquiry features, or by using the contact information below.
2. Notices from the Developer may be made through in-app notices, website postings, store listings, push notifications, email, or other methods the Developer considers appropriate.

18. Assignment

You may not assign, transfer, pledge, or otherwise dispose of your status or rights and obligations under these Terms without prior written consent from the Developer. The Developer may transfer the Service business, together with its status, rights, obligations, and user information, to a third party.

19. Severability

If any provision or part of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

20. Governing Law and Jurisdiction

1. These Terms are governed by the laws of Japan.
2. Any dispute between you and the Developer relating to the Service or these Terms will be subject to the exclusive jurisdiction of the district court or summary court having jurisdiction over the Developer's address as the court of first instance.
