Privacy Policy

I, Sho Fujimoto (hereinafter referred to as "Developer"), establish this Privacy Policy (hereinafter referred to as "this Policy") regarding the handling of user information in the mobile application "Harem" (hereinafter referred to as "the App") that I provide. The App is provided as an ad-supported service and is intended to be used as-is. This Policy aims to comply with laws concerning the protection of personal information (hereinafter referred to as the "Personal Information Protection Act") and to appropriately protect users' privacy information.

Article 1 (Definition of Privacy Information)

In this Policy, "Privacy Information" refers to the combination of "Personal Information" and "Historical Information and Characteristic Information."

Personal Information: Refers to "personal information" as defined by the Personal Information Protection Act. Specifically, this includes information that can identify a specific individual, such as name, contact information (email address, phone number, etc.), account identifiers, and other descriptions.
Historical Information and Characteristic Information: Refers to information other than the above "Personal Information" that is collected when users use the App. Specifically, this includes functions used, pages viewed in the App, viewing dates and times, time spent on each page, App usage time, input information to generative AI (including text and text data extracted from images, but these are not stored on Developer's servers), search keywords, usage methods, usage environment (device OS information, model name, communication status, settings, etc.), IP addresses, Cookie information, location information (if permitted by the user), advertising identifiers (IDFA, AAID, etc.), device-specific IDs, etc.

Article 2 (Methods of Collecting Privacy Information)

Developer may collect users' privacy information in the following ways:

Provision by Users: When users register an account (the App may use account information provided by Apple or Google for subscription management, etc.) or use inquiry forms, they may provide personal information such as email addresses and other information.
Automatic Collection during App Use: To improve user convenience, improve services, and display appropriate advertisements, we may automatically collect historical information and characteristic information related to App usage (access logs, operation history, pages viewed in the App, viewing dates and times, time spent on each page, input information to generative AI, purchase information, etc.) and usage environment (device information, OS information, IP addresses, Cookies, advertising identifiers, location information).
Access to Camera Roll: To use the App's text recognition feature for images in the camera roll, we may request permission to access the device's camera roll (photo library). Through this access, image data explicitly selected by users is temporarily used within the device for text extraction processing, and the extracted text data is used as input information for generative AI. Selected image data and extracted text data are not stored on Developer's servers. Access permission is optional for users, but if denied, the relevant feature may not be available.
Access to Camera (Live Capture): To use the App's photo capture feature and text recognition feature for captured photos, we may request permission to access the device's camera. Image data obtained through this access is temporarily used on the server for object extraction processing within images, and the extracted object text data is used as input information for generative AI. Image data and extracted text data are not stored on Developer's servers. Access permission is optional for users, but if denied, the relevant feature may not be available.
Subscription Information: Purchase information related to the App's subscriptions is collected through the Apple App Store or Google Play Store. Developer does not directly obtain or store users' payment information such as credit card details.
Location Information: The App may collect device location information (only with user permission). Collected location information is used to provide personalized content, highly relevant recommendations, location-based service features, analyze user behavior, identify trends, improve overall App performance and features, and optimize advertising.

Article 3 (Purpose of Using Privacy Information)

Developer uses collected privacy information for the following purposes:

To provide, maintain, protect, and improve the service (including response generation by generative AI, providing object extraction features from photos, and providing personalized content)
For user identity verification, authentication, and account management
To respond to user inquiries
To make important announcements, necessary notifications, and communications including marketing promotions related to the App
To respond to violations of terms of use and prevent unauthorized use
To analyze service usage, create statistical data, improve services, and develop new services
(When involving camera access and camera roll access) To provide photo capture features or image selection features from camera roll, text extraction processing from image data, and input processing of such text data to generative AI
To provide and manage subscription services and related notifications
For advertising delivery and effectiveness measurement (we may analyze collected information and select and display advertisements presumed to be of higher interest to users)
For purposes incidental to the above purposes

Article 4 (Use of Generative AI)

The App uses generative AI technology provided by third parties (e.g., OpenAI, Google, etc.; hereinafter referred to as "AI Service Providers") to generate responses to users. Information entered by users (text and text data extracted from images) may be sent to the AI Service Provider's servers for response generation purposes. Please refer to the AI Service Provider's privacy policy for how transmitted information is handled by them. (The AI Service Provider's name and link to their privacy policy will be posted separately within the App or on the website.) Developer does not store users' input information on Developer's servers.

Article 5 (Use of Third-Party Services and Information Collection Modules)

The App may use services and information collection modules provided by the following third parties for service provision, usage analysis, advertising delivery, etc. Please check each company's website for information obtained by these third parties, purposes of use, privacy policies, opt-out methods, etc.

Developer may periodically send only aggregated, anonymized data that cannot identify individuals to external services for the purpose of improving the App and services.

Article 6 (Third-Party Provision of Privacy Information)

Developer will not provide personal information to third parties without obtaining prior consent from users, except in the cases specified in Articles 4 and 5, and in the following cases:

When required by law
When necessary to protect the life, body, or property of a person and it is difficult to obtain the person's consent
When particularly necessary for improving public health or promoting the sound growth of children and it is difficult to obtain the person's consent
When necessary to cooperate with a national agency, local government, or person entrusted by them in executing affairs prescribed by law, and obtaining the person's consent may impede the execution of such affairs (including fraud investigations and responding to government requests)
When outsourcing all or part of personal information handling within the scope necessary to achieve the purpose of use (outsourcing is limited to trusted service providers who agree to work for Developer, not use disclosed information independently, and comply with the rules set forth in this Privacy Policy. We will appropriately supervise outsourcing partners)
When personal information is provided due to business succession due to merger or other reasons
When Developer, in good faith, determines that disclosure is necessary to protect Developer's rights, user safety, or the safety of others

Article 7 (Disclosure, Correction, Suspension of Use of Personal Information)

When Developer receives a request from a user for notification of purpose of use, disclosure, correction of content, addition or deletion, or suspension of use or erasure, or suspension of third-party provision (hereinafter referred to as "Disclosure, etc.") of their personal information based on the provisions of the Personal Information Protection Act, Developer will respond without delay after verifying the person's identity (or notify that such personal information does not exist). However, this does not apply when Developer is not obligated to perform Disclosure, etc. under the Personal Information Protection Act or other laws.
A fee of 1,000 yen per request may be charged for notification of purpose of use and disclosure of personal information.

Article 8 (Correction and Deletion of Personal Information)

If users' personal information held by Developer is incorrect, users can request correction or deletion of personal information through procedures determined by Developer.
If Developer receives a request from the preceding paragraph and determines it is necessary to respond to the request, Developer will correct or delete the personal information without delay and notify the user.

Article 9 (Opt-Out Rights)

Users can easily stop the collection of user information by the App by uninstalling the App. Please use the standard uninstallation procedures provided by your mobile device or mobile application marketplace (App Store, Google Play Store, etc.). Also, if you do not wish to receive personalized advertisements, you can limit the use of advertising identifiers by changing your mobile device's OS settings (such as "Limit Ad Tracking" for iOS or "Opt out of Ads Personalization" for Android). However, this does not hide advertisements.

Article 10 (Data Retention Policy)

Developer will retain collected user information for the period during which users use the App and for a reasonable period necessary for service provision, compliance with legal obligations, dispute resolution, and contract performance. If users wish to delete user information they have provided, please contact the inquiry desk in Article 13. We will respond within a reasonable time.

Article 11 (Children's Privacy)

Developer does not intentionally collect personal information from children under 13 years of age or conduct marketing targeted at children under 13. The App is not intended for persons under 13 years of age. If it is discovered that a child under 13 has provided personal information, Developer will immediately delete such information from Developer's servers. If parents/guardians notice that their child has provided personal information, please contact the inquiry desk in Article 13. We will take necessary measures.

Article 12 (Security Management of Privacy Information)

Developer will take necessary and appropriate measures, including physical, electronic, and procedural protective measures, to prevent leakage, loss, or damage of handled privacy information and for other security management. We strive to implement technical and physical security measures. Specifically, this includes encryption of communications, implementation of access control, and non-storage of data (especially photos and extracted text). For specific details of security management measures, please contact the inquiry desk in Article 13.

Article 13 (Changes to Privacy Policy)

Developer may change the content of this Policy as necessary.
The changed Privacy Policy will be announced by updating within the App or this page (Privacy Policy page). Users are recommended to regularly check for changes to this Policy. If changes require user consent by law, Developer will obtain user consent through Developer's prescribed method. If users continue to use the App after changes (excluding changes requiring consent by law), they are deemed to have agreed to the changed Policy.

Article 14 (Governing Law)

Example: This Policy shall be governed by Japanese law.

Article 15 (Consent)

By using the App, users are deemed to have consented to the processing (collection, use, provision, etc.) of user information as set forth in this Policy, including current and future revisions.
