AI Therapy Terms of Service
These Terms of Service (the "Terms") set out the conditions for using the smartphone app "AI Therapy" (the "App") provided by Sho Fujimoto (the "Developer"). By using the App, you agree to these Terms.
1. About the App
The App is a multilingual app in which you chat with AI characters and can talk about your everyday worries and frustrations. As you keep talking, the trust between you and a character (closeness) grows, and the character's way of speaking and expressions change. In addition to the provided characters, you can create your own characters by setting their name, personality, images, and more.
All characters, conversations, expressions, and closeness levels in the App are fiction generated by AI and have no connection to real people or organizations.
2. Eligibility
You must be at least 13 years old to use the App. Minors may use the App only with the consent of a parent or guardian.
3. Free Use
The App is free to use. Full-screen ads are shown after a certain number of messages you send. Ad timing may change as the App is improved.
4. Advertising
- The App displays ads through Google AdMob. Displaying ads involves the information handling described in the Privacy Policy.
- Advertisers are responsible for the content of their ads and for the products and services they link to.
- You must not click ads fraudulently or interfere with how ads are displayed.
5. AI-Generated Content
- Character replies, expressions, and the summary about you are generated by AI. AI-generated content may be inaccurate, unnatural, inappropriate, or different from what you intended.
- Do not rely on AI-generated content for medical, legal, financial, psychological, or other professional judgments, or for important decisions.
- The Developer does not guarantee what characters say, the consistency of conversations, or any particular reaction or outcome.
6. Not Medical or Professional Support
- The App does not provide medical care, diagnosis, treatment, psychotherapy, or counseling. The words "Therapy" and "Therapist" in the App's name describe its purpose of helping you feel lighter by having someone listen to you. They do not mean support from a doctor, licensed psychologist, or any other qualified professional.
- The AI characters do not identify medical conditions or give advice about medication or treatment. If you continue to feel unwell physically or mentally, or want to know about treatment or medication, please consult a doctor or another professional.
- If you are in a situation that affects your life or safety, do not rely on the App. For example, if you are thinking about dying, feel you might hurt yourself, or are being harmed by someone. Contact one of the following immediately:
- Your local emergency number (in Japan, 119 or 110)
- A crisis or support line
- Someone you trust
- The App cannot respond to emergencies, and the Developer does not review the content of your conversations.
7. Content You Must Not Enter
Do not enter, send, or set:
- Personal or confidential information such as your real name, address, phone number, email address, passwords, or payment details
- Other people's personal information, or content that invades someone's privacy
- Images or text that infringe the portrait rights, copyrights, or other rights of others (including in character settings)
- Content that violates the law or public order and morals
- Defamation, threats, harassment, or discriminatory expressions
- Content that sexualizes minors, or excessively sexual or violent content
- Content that promotes crime or dangerous acts
8. Prohibited Conduct
- Violating laws, these Terms, or platform terms
- Placing an excessive load on the App, its servers, or third-party services
- Unauthorized access, reverse engineering, modification, or using bots
- Exploiting bugs or vulnerabilities in the App
- Interfering with the operation of the App, its ads, or AI generation
- Copying, reposting, selling, distributing, or modifying the App's content without permission
- Any other conduct the Developer reasonably considers inappropriate
9. Data Storage
Data such as conversation history, characters, closeness, and the summary about you is stored on your device. It may be lost if you delete the App, your device fails or is changed, or due to OS behavior, and the Developer cannot restore it.
10. Intellectual Property
All intellectual property rights in the App, its characters, images, text, programs, and other content belong to the Developer or the rightful owners. You may use the App only for personal, non-commercial purposes. Rights in images and text you set yourself belong to you or the rightful owners.
11. Third-Party Services
The App uses third-party services for advertising, AI generation, usage analytics, and server infrastructure. Your use of these may be subject to each provider's terms and privacy policy.
12. Changes, Suspension, and Termination of the Service
The Developer may change the content, features, or delivery of the App, or suspend or end it. If we end the App, we will give reasonable advance notice in the App or elsewhere.
13. Disclaimer
- The Developer does not guarantee that the App is accurate, complete, useful, continuously available, or free of defects, or that it will produce the results you expect.
- Except in cases of willful misconduct or gross negligence by the Developer, the Developer is not liable for damages you incur in connection with the App. Where the Developer is liable, liability is limited to direct and ordinary damages you actually incur.
- The preceding paragraph does not apply to the extent that the Consumer Contract Act of Japan or other applicable laws do not permit the Developer's liability to be excluded or limited.
14. Changes to These Terms
The Developer may change these Terms when necessary. We will announce the revised Terms and their effective date in advance in the App or on our website. By using the App on or after the effective date, you agree to the revised Terms.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. Any dispute relating to the App shall be subject to the exclusive jurisdiction, in the first instance, of the Japanese court having jurisdiction over the Developer's location. However, disputes with users who are consumers are subject to the jurisdiction prescribed by law.
